RÉSUMÉ: Cet article propose une analyse détaillée des considérations de Hans-Georg Gadamer sur l’herméneutique théologique proprement dite. Pensée dans et pour la foi chrétienne, la conception de l’herméneutique théologique qu’il met en avant se veut essentiellement une herméneutique du texte biblique. Les réflexions de Gadamer sur ce thème nous conduisent cependant tout droit dans sa théorie de la littérature. La question directrice devient celle de la nature du texte religieux (entendons : du texte biblique, reçu en son unité canonique) en (...) tant que texte éminent, dont la structure singulière est mise en relief au moyen d’une éclairante comparaison avec les textes poétique, philosophie et juridique. L’Écriture, en tant qu’elle répond à la structure textuelle de la promesse, exige du lecteur une forme particulière d’appropriation qui trouve sa réalisation exemplaire dans la prédication. Toutefois, contre une lecture (Ommen, Eberhard, etc.) qui insiste sur la discontinuité de l’herméneutique théologique de Gadamer avec sa propre oeuvre philosophique, je soutiens la thèse de leur foncière cohérence. ABSTRACT: This paper offers a detailed analysis of Hans-Georg Gadamer’s considerations on theological hermeneutics proper. Thought within and for the Christian faith, the conception of theological hermeneutics he puts forward is mainly understood as a hermeneutics of the biblical text. However, Gadamer’s reflections on this theme bring us straight to his theory of literature. The guiding question becomes that about the nature of the religious text (meaning : the biblical text, received in its canonical unity) as eminent text, which peculiar structure is thrown into relief through an enlightening comparison with the poetical, the philosophical and the legal text. The Scripture, in that it has the textual structure of a promise, requires from the reader a particular form of appropriation, which finds its exemplary fulfillment in preaching. Against a reading that emphasizes discontinuity between Gadamer’s theological hermeneutics and his own philosophical work (Ommen, Eberhard, etc.) I defend the thesis of their fundamental coherence. RÉSUMÉ: Cette dissertation met en relief quelques-unes des incidences majeures de l’herméneutique philosophique de Hans-Georg Gadamer sur la manière dont la théologie contemporaine se définit comme discipline. Après avoir éclairé la philosophie gadamérienne à la lumière de sa filiation avec Wilhelm Dilthey, Edmund Husserl et Martin Heidegger, je propose une étude des principales thèses herméneutiques de Gadamer en prenant comme fil conducteur la question de la nature de la vérité herméneutique. Suit une analyse détaillée des considérations gadamériennes de l’herméneutique théologique (...) proprement dite. Contre une lecture qui insiste sur la discontinuité de l’herméneutique théologique de Gadamer avec sa propre œuvre philosophique, je soutiens la thèse de leur foncière cohérence. Je formule enfin, dans une visée prospective, quelques questions fondamentales à partir desquelles se dégagent des idées directrices pour la compréhension de soi de la théologie. ABSTRACT: This dissertation brings to attention some of the major effects of Hans-Georg Gadamer’s philosophical hermeneutics on the way contemporary theology as a discipline defines itself. After having introduced Gadamer’s philosophy in light of its filiation to Wilhelm Dilthey, Edmund Husserl and Martin Heidegger, I propose a study of his main hermeneutical theses, following the lead of the question of the nature of hermeneutical truth. Then comes a detailed analysis of Gadamer’s reflections on theological hermeneutics proper. Against a reading that emphasizes discontinuity between Gadamer’s theological hermeneutics and his own philosophical work I defend the thesis of their fundamental coherence. L'oeuvre philosophique de Hans-Georg Gadamer offre des concepts éclairants pour penser les rapports de la modernité occidentale avec son héritage religieux. Elle jette notamment une lumière précieuse sur la relative rupture avec la religion qui marque la réalité sociopolitique contemporaine de plusieurs cultures de l'Ouest. Dans la présente contribution, il sera question de la place que peut occuper, dans la perspective de Gadamer, la religion (au sens générique du terme) dans l'ethos occidental. Mon propos consistera dans un premier temps à (...) souligner brièvement la pertinence de l'herméneutique gadamérienne pour la mise en relief de la place que conserve la religion dans la situation herméneutique de l'Occident actuel, en prenant pour concept phare celui de travail de l'histoire (Wirkungsgeschichte). Je chercherai, dans un deuxième temps, à dégager, à partir des écrits plus tardifs de Gadamer, quelques indications sur le rôle que peut jouer la religion dans le devenir solidaire de l'humanité. RÉSUMÉ : Dans la présente contribution, l’auteur cherche à identifier ce qui, sur le plan théologique, peut inciter aujourd’hui une large part du mouvement évangélique à défendre, en face du discours scientifique moderne, une lecture littérale de Gn 1,1–3,24. La démarche consiste à relever, dans la théologie évangélique, les principaux points d’ancrage du créationnisme, par l’analyse générale de deux approches des récits de la Création et surtout par la mise en relief du rôle déterminant que jouent les premiers chapitres de (...) la Bible dans l’anthropologie biblique et, par là, dans l’ensemble de la théologie chrétienne traditionnelle. ABSTRACT: In this contribution, the author seeks to identify what it is, theologically speaking, that could incite a large portion of today’s evangelical movement to defend a literal reading of Gen 1:1- 3:24. This exercise consists of discussing the foundational points of creationism in evangelical theology, through general analysis of two approaches to the Creation narratives, and especially through highlighting the definitive role played by the first chapters of the Hebrew Bible in biblical anthropology and thereby in traditional Christian theology. This paper advocates a new reading of Nelson Goodman’s new riddle of induction. According to Ian Hacking, this famous problem conveys a “pure nominalism”, as it grounds Goodman’s denial regarding the existence of natural kinds. While this interpretation is somewhat convincing, it suffers the major flaw of not corresponding to what Goodman himself understood by “nominalism”. Nominalism, in a goodmanian sense, is indeed primarily a technical demand, which stems from the so-called “calculus of individuals”. I argue that (...) this mereological definition of nominalism allows to understand the new riddle of induction afresh. As a result, Goodman’s riddle is “hyper-nominalist”, i.e., nominalist in a distinct and stronger sense than what Hacking suggested. (shrink)

Paul Goodman, 1960’larda modern Amerikan toplumunun organize sistemi içerisinde dönemin gençliğinin sorunlarını ön plana çıkaran ‘Growing Up Absurd: Problems of Youth in the Organized System’ (Saçmayı Büyütmek: Organize Sistemde Gençliğin Problemleri, 1960) eseri ile sosyal bir eleştirmen olarak ön plana çıkmıştır. Amerikalı bir düşünür olan Paul Goodman’ın kısa öyküler, romanlar, şiirler ve makalelerden oluşan çalışmaları, siyaset, sosyal teori, eğitim, kentsel tasarım, edebi eleştiri, hatta psikoterapi gibi geniş bir yelpazeye dağılmıştır. Onun temel argümanı (1960: 9-10) tek bir merkez etrafında (...) örgütlenen teknoloji toplumunun başarısızlıklarını eleştirerek, mevcut düzenin insanın doğasına uygun bir biçimde yeniden inşasını vurgulamaktadır. Goodman’ın yeniden inşa süreci içerisinde insan doğasına önem veren faaliyete dayalı anarşist ideolojisi, sorumluluk duygusunun homojen bir şekilde bireyler arasında paylaşılması gerektiğini vurgular. Goodman merkeziyetçi olmayan siyaset anlayışı ile kendisini Amerikan siyasetinin ve kültürünün karşısında yer alan bir pozisyonda konumlandırmaktadır (Honeywell, 2011: 1). Diğer bir deyişle Goodman (1960: 36), anarşist geleneği formüle etmek amacıyla yirminci yüzyıl Amerikası’nın içinde bulunmuş olduğu mevcut durumdan yola çıkarak eleştirilerini ademi merkeziyetçilik, katılımcı demokrasi, özerk toplum temaları üzerine temellendirmiştir. -/- Goodman’a göre, sosyal, kültürel, ahlâk ve eğitim gibi alanlarda uygulanan kurallar günümüz devletlerini etkisi altına alan kapitalist düzen tarafından belirlenmektedir (Bakır, 2016: 110). Bu durum Goodman’ın da içerisinde bulunduğu anarşist düşünürler tarafından kabul edilebilecek bir husus değildir, çünkü anarşistler mevcut düzenin ve sosyal yaşamın otorite ve itaat yapılarıyla güçlendirilen belirli yaklaşımlar ile kontrol altına alınmasını, insanların fikirlerini özgürce ifade edemeyeceği, bir nevi entelektüel bir hapishane içerisinde yaşaması anlamına geleceğinden dolayı karşı çıkmaktadırlar (Sheean, 2003: 122). Aynı nedenlerden dolayı Goodman, modern liberalizm ve Marksizm gibi alternatif radikal ideolojileri yerinden yönetim düşüncesi ve sosyal mühendislik konusundaki eğilimleri dolayısıyla reddetmektedir. Goodman için anarşizm, özgürlük ve toplumsal değişime yeterli düzeyde arka çıkabilecek tek ideolojik çerçeve olarak görülmektedir. Ona göre (2010: 143), “anarşizm ya da daha iyisi, anarko-pasifizm (toplumsal değişim hareketleri içerisinde örgütlü şiddete ve kurumlara karşı çıkan anarşist anlayış) günümüzün gelişmiş toplumlarının bürokrasilerini, karar verme konusunda aşırı merkezîleşmelerini ve sosyal mühendislik gibi problematik durumlarını ve tehlikelerini tutarlı bir şekilde öngörmüştür”. -/- Siyaset, sosyoloji ve felsefe gibi çeşitli alanlar içerisinde etkili olan anarşist kuramlar, radikal bir söylem olarak eğitimcileri ve araştırmacıları yeni öğretilere ve uygulamalara teşvik etme konusunda itici bir güç oluşturabilmektedirler. Anarşist yaklaşımlardan eğitim kuramı ve araştırmalara yönelik daha belirleyici bir rol alması beklenmektedir, ancak bu yaklaşımlar mevcut radikal akademik görüşü büyük ölçüde etkisi altına alan Marksizm’in eğitim alanında göstermiş olduğu aynı etkiyi gösterememiştir. Anarşist düşünceleri eğitim alanı içerisinde daha etkili ve görünür kılabilmek amacıyla Paul Goodman, Francisco Ferrer ve Alexander Neill’ın ileri sürmüş olduğu çeşitli düşünceler, girişimler ve uygulamalar ortaya çıkmıştır. Bu doğrultuda Goodman’ın anarşizme ilişkin düşünceleri ile bu çalışma sıkı bir anarşizm tahlili, eleştirisi ve felsefesinden öte anarşist anlayışın eğitimdeki uygulanabilirliğine yönelik bir soruşturma içerisine girmekte ve anarşist yaklaşımın mevcut eğitim sistemlerinden hangi yönleriyle farklılaştığını, sonucunda etkili bir eğitim anlayışı ortaya koyup koyamadığını tartışmaktadır. I present a solution to the epistemological or characterisation problem of induction. In part I, Bayesian Confirmation Theory (BCT) is discussed as a good contender for such a solution but with a fundamental explanatory gap (along with other well discussed problems); useful assigned probabilities like priors require substantive degrees of belief about the world. I assert that one does not have such substantive information about the world. Consequently, an explanation is needed for how one can be licensed to act as (...) if one has substantive information about the world when one does not. I sketch the outlines of a solution in part I, showing how it differs from others, with full details to follow in subsequent parts. The solution is pragmatic in sentiment (though differs in specifics to arguments from, for example, William James); the conceptions we use to guide our actions are and should be at least partly determined by preferences. This is cashed out in a reformulation of decision theory motivated by a non-reductive formulation of hypotheses and logic. A distinction emerges between initial assumptions--that can be non-dogmatic--and effective assumptions that can simultaneously be substantive. An explanation is provided for the plausibility arguments used to explain assigned probabilities in BCT. -/- In subsequent parts, logic is constructed from principles independent of language and mind. In particular, propositions are defined to not have form. Probabilities are logical and uniquely determined by assumptions. The problems considered fatal to logical probabilities--Goodman's `grue' problem and the uniqueness of priors problem are dissolved due to the particular formulation of logic used. Other problems such as the zero-prior problem are also solved. -/- A universal theory of (non-linguistic) meaning is developed. Problems with counterfactual conditionals are solved by developing concepts of abstractions and corresponding pictures that make up hypotheses. Spaces of hypotheses and the version of Bayes' theorem that utilises them emerge from first principles. -/- Theoretical virtues for hypotheses emerge from the theory. Explanatory force is explicated. The significance of effective assumptions is partly determined by combinatoric factors relating to the structure of hypotheses. I conjecture that this is the origin of simplicity. (shrink)

RESUMO A alimentação é o fator que mais onera um sistema de produção animal. Assim, a utilização de diferentes estratégias de alimentação dos animais ainda é o grande desafio da nutrição animal, principalmente, levando em consideração as exigências nutricionais de diferentes categorias de ruminantes, em especial bovinos em regiões tropicais, haja vista que a sazonalidade na produção de forragens afeta diretamente a produção bovina, promovendo inadequação no atendimento das exigências nutricionais dos animais principalmente em minerais e vitaminas. Uma alimentação que (...) não atenda as exigências nutricionais dos ruminantes gera prejuízos no sistema de produção, além de, em casos mais graves, ocasionar a perda do animal. Estudos que abordam o efeito e a importância de vitaminas e minerais na nutrição bovina são escassos e necessários. Recentemente a National Research Council (NRC) apresentou novos registros das exigências nutricionais das vitaminas e minerais. Essas alterações proporcionam um impacto econômico significativo em relação à nutrição animal. Thus, the use of different animal feeding strategies is still the great challenge of animal nutrition, taking into account the nutritional requirements of different categories of ruminants, especially cattle in tropical regions, given that seasonality in forage production directly affects cattle production, promoting inadequacy in meeting the nutritional requirements of animals, mainly in minerals and vitamins. A diet that does not meet the nutritional requirements of ruminants generates losses in the production system, in addition to, in more serious cases, causing the loss of the animal. Studies that address the effect and importance of vitamins and minerals in bovine nutrition are scarce and necessary. Recently the National Research Council (NRC) presented new records of the nutritional requirements of vitamins and minerals. These changes provide a significant economic impact on animal nutrition. Il problema apparentemente insolubile di una giustificazione non circolare dell’induzione diverrebbe più abbordabile se invece di chiederci solo cosa ci assicura che un fenomeno osservato si riprodurrà in modo uguale in un numero potenzialmente infinito di casi futuri, ci chiedessimo anche come si spiega che esso si sia manifestato fin qui in modo identico e senza eccezioni in un numero di casi finito ma assai alto. E’ questa l’idea della giustificazione abduttiva dell’induzione, avanzata in forme diverse da Armstrong, Foster e (...) BonJour: serie talmente regolari di fenomeni sono da un punto di vista logico talmente improbabili che se il mondo fosse puramente casuale (se cioè gli eventi si presentassero con frequenza proporzionale alla loro probabilità logica) esse non potrebbero verificarsi se non per una coincidenza miracolosa. Pertanto, tali regolarità si spiegano solo assumendo che siano prodotte da meccanismi o necessità nomiche; ma se questo è il caso, è corretto concludere che tali regolarità persisteranno anche in futuro senza eccezioni, e dunque le inferenze induttive su di esse sono giustificate. Anche Kornblith argomenta dall’effettivo successo delle inferenze induttive all’esistenza di regolarità oggettive in natura; mentre Sankey parte dall’ uniformità della natura per giustificare l’induzione. Congiungendo le due argomentazioni, dunque, si ottiene di nuovo una giustificazione dell’induzione in base all’argomento del “se non è un miracolo …”. Un ostacolo su questa via è specificare in che senso la natura sia uniforme (dato che ovviamente non lo è in ogni suo aspetto) e di quali regolarità possiamo aspettarci che persistano senza eccezione anche in futuro (dato che evidentemente non tutte lo fanno: l’acqua non bolle sempre a 100°, la pressione non è sempre funzione della temperatura, e così via). Entrano qui in gioco le conoscenze di sfondo e la ripetizione delle osservazioni in condizioni diverse, che ci mostrano quali circostanze siano rilevanti al verificarsi del fenomeno dato. In tal modo, le nostre descrizioni delle regolarità naturali convergono su descrizioni che specificano sia le condizioni individualmente necessarie e congiuntamente sufficienti, sia tutti gli argomenti delle funzioni che costituiscono tali regolarità. Ciò consente di formulare i principi di Uniformità della Natura e di Induzione in modo non generico (e dunque, a seconda della formulazione, vuoto o eccessivo), ma circostanziato: così essi asseriscono, rispettivamente, che la natura è uniforme negli aspetti evidenziati dalle descrizioni su cui convergiamo grazie alle osservazioni ripetute, e che solo queste descrizioni possono essere induttivamente generalizzate. Ciò consente anche di risolvere enigmi alla Goodman, quali: poiché le osservazioni ci hanno mostrato (solo) il verificarsi di una data regolarità fino al momento presente t, come possiamo presumere che essa si verificherà anche dopo t? La risposta è che osservazioni e conoscenza di sfondo non ci dicono che vi sia alcun limite temporale tra le condizioni necessarie della regolarità data. (shrink)

The artefacts produced by artists during their creation of works of art are very various: paintings, writings, musical scores, and so on. I have a general thesis to offer about the relations of artefacts and artworks, but within the confines of this article I shall mainly discuss cases drawn from the art of painting, central specimens of which seem to be autographic in Nelson Goodman's sense, namely such that even the most exact duplication of them does not count as (...) producing the same work of art. My view will be that an artwork (such as a painting) and its associated artefact are not identical, and nor is the artefact in any sense part of the painting in question,2 but that nevertheless it is still possible to maintain the view that paintings are autographic (which view I shall call l the autographic thesis). I shall proceed initially through presentation of some counter-examples to common assumptions as to the relations of artefacts and artworks, and then present an alternative 'representational' theory of their relations. De la nécessité et de l'utilité de développer une philosophie spécifique pour la technologie de la blockchain, mettant l'accent sur les aspects ontologiques. Après une Introduction qui met en évidence les principales orientations philosophiques de cette technologie émergente, dans La technologie blockchain j’explique le fonctionnement de la blockchain, en analysant les directions de développement ontologique de cette technologie dans Conception et modélisation. La section suivante est consacrée à la principale application de la technologie de la blockchain, Bitcoin, avec les implications (...) sociales de cette crypto-monnaie. Il suit une section de Philosophie dans laquelle j'identifie la technologie de la blockchain au concept d'hétérotopie développé par Michel Foucault et je l'interprète à la lumière de la technologie de notation développée par Nelson Goodman en tant que système de notation. Dans la section Ontologie, je présente deux voies de développement que j'estime importantes: une Ontologie narrative, basée sur l'idée d'ordre et de structure de l'histoire transmise à travers l'histoire narrative de Paul Ricoeur, et le système de l'Ontologie d'entreprise basé sur des concepts et des modèles d'entreprise, spécifiques au Web sémantique, que je considère comme le plus développé et qui deviendra probablement le système ontologique formel, du moins en ce qui concerne les aspects économiques et juridiques de la technologie de la blockchain. It has become popular of late to identify the phenomenon of thinking a singular thought with that of thinking with a mental file. Proponents of the mental files conception of singular thought claim that one thinks a singular thought about an object o iff one employs a mental file to think about o. I argue that this is false by arguing that there are what I call descriptive mental files, so some file-based thought is not singular thought. Descriptive mental files (...) are mental files for which descriptive information plays four roles: determines which object the file is about, if any, it sets limits on possible mistakes that fall within the scope of successful reference for the file, it acts as a ‘gatekeeper’ for the file, and it determines persistence conditions for the file. Contrary to popular assumption, a description playing these roles is consistent with the file-theoretic framework. Recognising this allows us to distinguish the notion of singular thought from that of file-thinking and better understand the nature and role of both. (shrink)

Con el fin de clarificar dicha distinción, en el presente trabajo se plantea una noción básica de estado mental y, especialmente, una definición clara de lo que es un concepto y las características esenciales de los estados en que estos aparecen. Lo que se (...) sostiene al final es que hay buenas y suficientes razones para hablar de contenidos conceptuales y contenidos no-conceptuales, en lugar de hacerlo de contenidos más o menos conceptuales. This paper has a narrow and a broader target. The narrow target is a particular version of what I call the mental-files conception of singular thought, proposed by Robin Jeshion, and known as cognitivism. The broader target is the MFC in general. I give an argument against Jeshion's view, which gives us preliminary reason to reject the MFC more broadly. I argue Jeshion's theory of singular thought should be rejected because the central connection she makes between significance and singularity does (...) not hold. However, my argument grants Jeshion's claim that there is a connection between significance and file-thinking. The upshot is not only that we have reason to reject Jeshion's significance constraint on singular thought, but that we have reason to question the connection made by MFC proponents between file-thinking and singularity. A thesis I call the name-based singular thought thesis is part of orthodoxy in contemporary philosophy of mind and language: it holds that taking part in communication involving a proper name puts one in a position to entertain singular thoughts about the name’s referent. I argue, first, that proponents of the NBT thesis have failed to explain the phenomenon of name-based singular thoughts, leaving it mysterious how name-use enables singular thoughts. Second, by outlining the reasoning that makes the NBT thesis (...) seem compelling and showing how it can be resisted, I argue that giving up the NBT thesis is not a cost, but rather a benefit. I do this by providing an expanded conception of understanding for communication involving names, which sheds light on the nature of communication involving names and the structure of name-using practices. Intellectual property (IP) can internalize positive externalities associated with the creation and discovery of ideas, thereby increasing investment in efforts to create and discover ideas. However, IP law also causes negative externalities. Strict IP rights raise the transaction costs associated with consuming and building on existing ideas. This causes a tragedy of the anticommons, in which valuable resources are underused and underdeveloped. By disincentivizing creative projects that build on existing ideas, IP protection, even if it increases original innovation, can inadvertently (...) reduce the rate of iterative innovation. The net effect of IP law on innovation and welfare depends on the relative magnitude of these positive and negative externalities. We argue that the current regime probably suffers from excessive, and excessively rigid, IP protection. This motivates the search for institutional alternatives and complements. We suggest that a monocentric IP rights regime may not be the only, or the most efficient, way to internalize the positive externalities of innovation. The knowledge economy supports the emergence of diverse, polycentric forms of bottom-up self-governance, both market and community led, that entail the citizen coproduction of the norms and practices of intellectual creation and discovery. The definitions of ‘deduction’ found in virtually every introductory logic textbook would encourage us to believe that the inductive/deductive distinction is a distinction among kinds of arguments and that the extension of ‘deduction’ is a determinate class of arguments. In this paper, we argue that that this approach is mistaken. Specifically, we defend the claim that typical definitions of ‘deduction’ operative in attempts to get at the induction/deduction distinction are either too narrow or insufficiently precise. We conclude by presenting a (...) deflationary understanding of the inductive/deductive distinction; in our view, its content is nothing over and above the answers to two fundamental sorts of questions central to critical thinking. A large chorus of voices has grown around the claim that theistic belief is epistemically suspect since, as some cognitive scientists have hypothesized, such beliefs are a byproduct of cognitive mechanisms which evolved for rather different adaptive purposes. This paper begins with an overview of the pertinent cognitive science followed by a short discussion of some relevant epistemic concepts. Working from within a largely Williamsonian framework, we then present two different ways in which this research can be formulated into an (...) argument against theistic belief. We defend the thesis that every necessarily true proposition is always true. Since not every proposition that is always true is necessarily true, our thesis is at odds with theories of modality and time, such as those of Kit Fine and David Kaplan, which posit a fundamental symmetry between modal and tense operators. According to such theories, just as it is a contingent matter what is true at a given time, it is likewise a temporary matter what is true at (...) a given possible world; so a proposition that is now true at all worlds, and thus necessarily true, may yet at some past or future time be false in the actual world, and thus not always true. We reconstruct and criticize several lines of argument in favor of this picture, and then argue against the picture on the grounds that it is inconsistent with certain sorts of contingency in the structure of time. El presente estudio ofrece una interpretación de naturaleza ontológica a uno de los fenómenos más divulgados recientemente por los medios informativos de comunicación: la displicencia de los sujetos al seguimiento de normas sociales. El trabajo se centra, especialmente, en los casos en los que se asume que la indiferencia a las normas tiene como causa la condición del privilegiado social. Argumenta que la inobservancia a las normas, más que ser un asunto de desigualdad social, es la sintomatología de importantes hendiduras (...) en la ontología de la realidad social. Así, tres partes conforman este trabajo. En la primera se describen algunos casos que, desde los medios de comunicación, se presentan como representativos en la inobservancia a las normas sociales, especialmente, aquellos que son interpretados como un asunto de abuso de privilegio social. En la segunda parte, a partir de algunos trabajos de John Austin, Ulises Moulines y Gottlob Frege, se presenta una concepción de normas sociales, y su valor para la construcción de la ontología social. En la tercera parte, desde la propuesta del filósofo John Searle, se describen algunos rasgos esenciales de la ontología de la realidad social. Se concluye que el no seguimiento de las normas sociales socava los modos de existencia de la realidad social, y que los casos interpretados por los medios de comunicación como asunto de desigualdad social, requieren una interpretación que tenga en cuenta la estructura de la realidad social. En el presente texto se aborda la discusión entre economistas y abogados acerca del control judicial en aspectos económicos con el propósito de mostrar el carácter democrático de éste. El análisis contendrá tres partes: (i) contextualización del debate a partir del principio de distribución de poderes; (ii) planteamiento del debate a partir de dos lecturas de la Constitución de 1991, ya sea que se enfatice en el liberalismo clásico contenido en la carta o en lo “social” del Estado Social de (...) Derecho de la misma; (iii) por último, se abordarán algunas de las principales críticas al control constitucional en cuestiones económicas, así como el análisis de la legitimidad y conveniencia de dicho control. En esta última parte se hará especial énfasis en la objeción de que la intervención judicial en la economía sería antidemocrática y la respuesta que a la misma puede plantearse. (shrink)

In the face of continuing assumptions by many scientists and journal editors that p-values provide a gold standard for inference, counter warnings are published periodically. But the core problem is not with p-values, per se. A finding that “p-value is less than α” could merely signal that a critical value has been exceeded. The question is why, when estimating a parameter, we provide a range (a confidence interval), but when testing a hypothesis about a parameter (e.g. µ = x) we (...) proceed as if “=” entails exact equality of the parameter with x. That standard is hard to meet, and is not a standard expected for power calculations, where we are satisfied to reject a null hypothesis H0 if the result is merely “detectably” different from (exact) H0. This paper explores, with resampling (simulation) methods, the impacts on p-values, and alternatives, if the null hypothesis is defined as a thick or thin range of values. It also examines, empirically, the extent to which the p-value may or may not be a good predictor of the probability that H0 is true, given the distribution of the data. (shrink)

We often speak as if there are merely possible people—for example, when we make such claims as that most possible people are never going to be born. Yet most metaphysicians deny that anything is both possibly a person and never born. Since our unreflective talk of merely possible people serves to draw non-trivial distinctions, these metaphysicians owe us some paraphrase by which we can draw those distinctions without committing ourselves to there being merely possible people. We show that such paraphrases (...) are unavailable if we limit ourselves to the expressive resources of even highly infinitary first-order modal languages. We then argue that such paraphrases are available in higher-order modal languages only given certain strong assumptions concerning the metaphysics of properties. We then consider alternative paraphrase strategies, and argue that none of them are tenable. If talk of merely possible people cannot be paraphrased, then it must be taken at face value, in which case it is necessary what individuals there are. Therefore, if it is contingent what individuals there are, then the demands of paraphrase place tight constraints on the metaphysics of properties: either (i) it is necessary what properties there are, or (ii) necessarily equivalent properties are identical, and having properties does not entail even possibly being anything at all. This paper is a study of higher-order contingentism – the view, roughly, that it is contingent what properties and propositions there are. We explore the motivations for this view and various ways in which it might be developed, synthesizing and expanding on work by Kit Fine, Robert Stalnaker, and Timothy Williamson. Special attention is paid to the question of whether the view makes sense by its own lights, or whether articulating the view requires drawing distinctions among possibilities that, according to (...) the view itself, do not exist to be drawn. The paper begins with a non-technical exposition of the main ideas and technical results, which can be read on its own. This exposition is followed by a formal investigation of higher-order contingentism, in which the tools of variable-domain intensional model theory are used to articulate various versions of the view, understood as theories formulated in a higher-order modal language. Our overall assessment is mixed: higher-order contingentism can be fleshed out into an elegant systematic theory, but perhaps only at the cost of abandoning some of its original motivations. After some years (or millennia) most works would no longer be considered eligible for "review." But an exception is called for, if the thrust of an older work is closely paralleled in a much more modern piece, as is the case between Plato's Theaetetus and Richard Rorty's acclaimed, and more recent volume, Philosophy and the Mirror of Nature. To fully understand and appreciate Rorty 's contribution to the subjects he raises, one must study his book in conjunction with Plato's Theaetetus-where (...) very similar issues have been discussed before. Both works concern a central question for philosophy: "What is knowledge?" The discussants in Plato's dialogue the Theaetetus, never do succeed in finding a satisfactory definition for knowledge, yet they at least realize to avoid thinking they know about the subject when, in fact, they lack that knowledge. In response to rapid technological changes in our society, there are calls by governments and industry for increased training of the workforce. But training alone is not sufficient to ensure success, even if talent, discipline and good fortune are all amply provided. When “training” goals require creativity, or decision making, or moral judgment, then adequate preparation must also include “education” in John Dewey’s sense—that is, imparting abilities to solve new problems and grasp novel meanings. Concluding this small monograph is a (...) proposed research agenda, which includes exploring the crucial role of “intuition” and related processes in abilities to generate hypotheses and solve problems. In its elaboration on the nature and limits of training, compared to education, the discussion includes a Thought Experiment, based on Bernard Suits’ exploration of rules and success in playing games. Most theories of parenthood assume, at least implicitly, that a child will grow up to be an independent, autonomous adult. However, some children with cognitive limitations or psychiatric illness are unable to do so. For this reason, these accounts do not accommodate the circumstances and responsibilities of parents of such adult children. Our article attempts to correct this deficiency. In particular, we describe some of the common characteristics and experiences of this population of parents and children, examine the unique aspects (...) of their relationships, review several philosophical accounts of parental obligations, consider how these accounts might be extrapolated to semiautonomous adult children, and provide suggestions about parental obligations to promote autonomy and independence in adult children with cognitive limitations or psychiatric illness. In extending accounts of parental responsibilities to the case of semiautonomous adults, we find that the parental role includes the duty to continue to provide care—indefinitely if necessary—while cultivating autonomy and independence. We present and discuss a counterexample to the following plausible principle: if you know that a coin is fair, and for all you know it is going to be flipped, then for all you know it will land tails.

We offer a general framework for theorizing about the structure of knowledge and belief in terms of the comparative normality of situations compatible with one’s evidence. The guiding idea is that, if a possibility is sufficiently less normal than one’s actual situation, then one can know that that possibility does not obtain. This explains how people can have inductive knowledge that goes beyond what is strictly entailed by their evidence. We motivate the framework by showing how it illuminates knowledge about (...) the future, knowledge of lawful regularities, knowledge about parameters measured using imperfect instruments, the connection between knowledge, belief, and probability, and the dynamics of knowledge and belief in response to new evidence. How is what we believe related to how we act? That depends on what we mean by ‘believe’. On the one hand, there is what we're sure of: what our names are, where we were born, whether we are sitting in front of a screen. Surety, in this sense, is not uncommon — it does not imply Cartesian absolute certainty, from which no possible course of experience could dislodge us. But there are many things that we think that we are (...) not sure of. For example, you might think that it will rain sometime this month, but not be sure that it will. Both what we're sure of and what we think have important normative connections to action. But the connections are quite different. This paper explores these issues with respect to assertion, inquiry, and decision making. We conclude by arguing that there is no theoretically significant notion of ‘full belief’ intermediate in strength between thinking and being sure. (shrink)

This chapter offers an opinionated introduction to higher-order formal languages with an eye towards their applications in metaphysics. A simply relationally typed higher-order language is introduced in four stages: starting with first-order logic, adding first-order predicate abstraction, generalizing to higher-order predicate abstraction, and finally adding higher-order quantification. It is argued that both β-conversion and Universal Instantiation are valid on the intended interpretation of this language. Given these two principles, it is then shown how we can use pure higher-order logic to (...) ask, and begin to answer, metaphysical questions with non-trivial implications. In particular, while we must reject the popular idea that structural differences between sentences correspond to parallel distinctions in the logical structure of extra-linguistic reality, it may still be possible to give a purely logical characterization of objectual aboutness and related notions. How might discourse generate political change? So far, democratic theorists have focused largely on how deliberative exchanges might shift political opinion. Responding to empirical research that casts doubt on the generalizability of deliberative mechanisms outside of carefully designed forums, this essay seeks to broaden the scope of discourse theory by considering speech that addresses participants’ identities instead. More specifically, we ask what may be learned about identity-oriented discourse by examining the practice of religious preaching. As we demonstrate, scholars of homiletics—the (...) study of preaching—have identified three core features that support its focus on identity: its unconditionality, its appeal to authoritative texts and traditions, and its diffuse instrumentality. We then ask what each of these features might look like in more straightforwardly political contexts. Finally, we address several normative questions raised by this practice, as a way of exploring the promises and dangers accompanying identity-oriented discourse more generally. (shrink)

Consider the sentence “Lois knows that Superman flies, but she doesn’t know that Clark flies”. In this paper we defend a Millian contextualist semantics for propositional attitude ascriptions, according to which ordinary uses of this sentence are true but involve a mid-sentence shift in context. Absent any constraints on the relevant parameters of context sensitivity, such a semantics would be untenable: it would undermine the good standing of systematic theorizing about the propositional attitudes, trivializing many of the central questions of (...) epistemology, the philosophy of mind, and the philosophy of action. In response to this problem, we prove a series of tenability results. We show that, given certain constraints on the parameters of context sensitivity, there is a broad class of principles of propositional attitude psychology whose good standing follows from corresponding claims about people’s mental representations. But these constraints also have some surprising consequences: they are jointly incompatible with coarse-grained theories of propositions, and they are in tension with a natural picture of how speakers and hearers coordinate on the interpretation of attitude ascriptions. In light of these consequences we explore different ways in which the contextualist picture might be developed, and argue that our preferred way compares favorably with Fregeanism and neo-Russellianism. We offer an interpretation of the mental files framework that eliminates the metaphor of files, information being contained in files, etc. The guiding question is whether, once we move beyond the metaphors, there is any theoretical role for files. We claim not. We replace the file-metaphor with two theses: the semantic thesis that there are irreducibly relational representational facts (viz. facts about the coordination of representations); and the metasemantic thesis that processes tied to information-relations ground those facts. In its canonical (...) statement, the ‘file’-theory makes reference to a certain kind of relational representational feature, and a certain kind of mental activity. Mental files need not come into it. In short, we posit mental filing without mental files. Our interpretation avoids awkward problems that arise on the standard interpretation and clarifies the explanatory commitments of the theory. (shrink)

Nelson Goodman (1906–1998) is one of the leading American philosophers of the twentieth century. His well-known book Languages of Art is considered a major contribution to analytical aesthetics. While his views on particular issues have often been criticized, on the whole, he is considered to be a leading figure in twentieth-century aesthetics. Contrary to such a stance, I intend to argue that Goodman’s overall contribution to aesthetics is not as outstanding and valuable as is often maintained. Rather, I (...) will try to show that his aesthetic views are grounded on a distorted representation of the earlier aesthetic tradition, without which they lose the novelty and originality ascribed to them. Once that representation is corrected, some of Goodman’s proposals turn out to be derivative and redundant. Additionally, where they do actually diverge from the earlier tradition and might stake a claim to originality, they turn out to be simply erroneous and misconceived, and sometimes even logically flawed. To conclude, Goodman’s lofty reputation as an aesthetician certainly requires major revision. (shrink)

Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. Implicitly, our findings question the soundness of using societal-level values measures. Implications for international business research are discussed. (shrink)

The so-called ‘mental files theory’ in the philosophy of mind stems from an analogy comparing object-concepts to ‘files’, and the mind to a ‘filing system’. Though this analogy appears in philosophy of mind and language from the 1970s onward, it remains unclear to many how it should be interpreted. The central commitments of the mental files theory therefore also remain unclear. Based on influential uses of the file analogy within philosophy, I elaborate three central explanatory roles for mental files. Next, (...) I outline several common criticisms of the file picture, which have been a source of resistance to the view. Finally, I outline several interpretations of the theory, thus highlighting that the best interpretation of the file-theory's central analogy remains a live issue. (shrink)

On the traditional relationalist conception of singular thought, a thought has singular content when it is based on an ‘information relation’ to its object. Recent work rejects relationalism and suggests singular thoughts are distinguished from descriptive thoughts by their inferential role: only thoughts with singular content can be employed in ‘direct’ inferences, or inferences that ‘trade on identity’. Firstly this view is insufficiently clear, because it conflates two distinct ideas—one about a kind of inference, the other a kind of process (...) that grounds inferences—under the title, ‘trading on identity’. Secondly, this leaves us without a notion that can be used as an alternative to relationalism about singular thought. The first notion is no more applicable to singular than to descriptive thought. The second may help us better understand singular thought, but does so, not by replacing the view that singular thoughts are information-based, but by helping us understand the nature of information-based thought. We show that, contrary to conventional wisdom, Frege’s distinction between sense and reference does not reconcile a classical logic of identity with apparent counterexamples to it involving proper names embedded under propositional attitude verbs.

Glucagon-like peptide-1 (GLP-1) receptor agonists, such as semaglutide, and dual GLP-1 and glucose-dependent insulinotropic polypeptide (GIP) receptor agonists, such as tirzepatide, have been found to be effective for treating obesity and diabetes, significantly reducing weight and the risk or predicted risk of adverse cardiovascular events. There is a global shortage of these medications that could last several years and raises questions about how limited supplies should be allocated. We propose a fair-allocation framework that enables evaluation of the ethics of current (...) practices and could guide governments, professional societies, and physicians in allocation decisions. In an essay on performance-enhancing drugs, author Chuck Klosterman (2007) argues that the category of enhancers extends from hallucinogens used to inspire music to steroids used to strengthen athletes—and he criticizes those who would excuse one means of enhancement while railing against the other as a form of cheating: After the summer of 1964, the Beatles started taking serious drugs, and those drugs altered their musical performance. Though it may not have been their overt intent, the Beatles took performance-enhancing drugs. (...) And . . . absolutely no one holds it against them. In Talking about, Unnsteinsson defends an intentionalist theory of reference by arguing that confused referential intentions degrade reference. Central to this project is a “belief model” of both identity confusion and unconfused thought. By appealing to a well‐known argument from Campbell, I argue that this belief model falls short, because it fails to explain the inferential behavior it promises to explain. Campbell's argument has been central in the contemporary literature on Frege's puzzle, but Unnsteinsson's account of confusion provides an opportunity (...) for more clarity about how the argument is best interpreted, and what it shows. Several quantitative surveys have been conducted internationally to gather empirical information about physicians’ general attitudes towards health care rationing. Are physicians ready to accept and implement rationing, or are they rather reluctant? Do they prefer implicit bedside rationing that allows the physician–patient relationship broad leeway in individual decisions? Or do physicians prefer strategies that apply explicit criteria and rules?

Conditional excluded middle (CEM) is the following principe of counterfactual logic: either, if it were the case that φ, it would be the case that ψ, or, if it were the case that φ, it would be the case that not-ψ. I will first show that CEM entails the identity of indiscernibles, the falsity of physicalism, and the failure of the modal to supervene on the categorical and of the vague to supervene on the precise. This paper is about the relevance of attitude-ascriptions to debates about singular thought. It examines a methodology (common to early acquaintance theorists [Kaplan 1968] and recent critics of acquaintance [Hawthorne and Manley 2012], which assumes that the behaviour of ascriptions can be used to draw conclusions about singular thought. Although many theorists (e.g. [Recanati 2012]) reject this methodology, the literature lacks a detailed examination of its implications and the challenges faced by proponents and critics. I isolate an assumption of the (...) methodology, which I call the tracking assumption: that an attitude-ascription which states that s Φ's that P is true iff s has an attitude, of Φ-ing, which is an entertaining of the content P (with entertain used in a stipulated sense). I argue that the tracking assumption must be rejected, not because it has deflationary consequences, but because it leads to unstable commitments. I also show that there are independent reasons to reject it, because ordinary attitude ascriptions underdetermine even the truth-conditions of the mental-states they ascribe. However, I argue, this does not involve rejecting the claim that attitude-ascriptions express relations between agents and contents. Instead, they state different relations depending on contextual factors other than the nature of the mental-states ascribed. (shrink)

This paper investigates a generalization of Boolean algebras which I call agglomerative algebras. It also outlines two conceptions of propositions according to which they form an agglomerative algebra but not a Boolean algebra with respect to conjunction and negation.
